OPEN ADDRESS TO THE PRESIDENT OF THE PARLIAMENT OF THE REPUBLIC OF CROATIA dr sc IVO SANADER by DJURO TRKULJA

Honorable President of the Government of the Republic of Croatia,



Aside with all that was said and done, I have decided to address You soliloquy whose echo shall reverberate long after riding this indeed most serious communiqué. Mr. President, this time I shall address You not as a president of the Refugee Aid Organization "Trkulja & associates" nor shall I write this from a position of a person that has refused, contrary to hundreds of thousands of citizens of Croatia, to "play the role" of going silently into the night. Into the night, Mr. President, of poverty, hopelessness and feeling of almost absolute powerless refugee existence. This time, I shall, and as I should, will address You as an intellectual, polyglot, erudite, altruist and above and beyond all of the above mentioned I shall approach You as a human being. Honorable Mr. President, Your solipsism, which has to a considerable degree contributed to prolonged on pure mythology based anathemas by which You Mr. President and Your predecessors have "formed" necessary truth, shall I deem to predict remain as a monolith of Your political striving. Much to Your disappointment, as well as mine, Mr. President deeds founded on a principle of abandonment of plurality of causes have throughout continuum of human history left only deep scars of destruction, both material and spiritual, and in a short periods of time necessarily led to serious moral dilemmas. Nota bene Mr, President even Plato, long time ago, uses "Cave myth", in "The State", I am of no doubt precisely as a cry for critical thinking about believes in esoteric statements and indeed leads in a direction of moral and ethical stamp which is here to stay for the duration.

Without any possibility of erring in knowledge that You have, purely using criterion of identity, placed in a general group based on ethnic background, and thus forced consequences, as well as the events to come in the near future be sculpted by such anahronic frame of mind; the frame of mind that I as a matter of necessity accept, yet solely as a part of a whole which in its formidable determination becomes in fact a substitute for moral and ethical paradigm which indeed represents both the root and the solution of substantional problems of refugee population, Mr. President. Mr. Sanader, utilitarism of a single act - singular ad valorem of uniqueness of final aim shaped in a demographically desired "State", has inherently denied essential wellbeing to hundreds of thousands of innocents, innocents in 1995, innocents in 2007, Mr. President of the Government of the Republic of Croatia. Mr. Sanader, it is indeed this never ending line of innocents yet without legal protection from alma mater, impoverished by the very acts - acts so atrocious that Your Government had to rely on most notorious deception to try to cover - of robbery committed by the very representatives of Your Government Mr. Ivo Sanader. ego non vi absolvo, is catalyst of a current situation as well as of the resulting consequences which will inevitably follow, ad fundum.

Mr. Ivo Sanader, my name is Djuro Trkulja and as You have, by now, without any doubt learned, dated 16th of June 2007, I have initiated a criminal lawsuit against You in front of Municipal court in Zagreb. Equally I stand sure that You are fully aware that the core of the lawsuit steams from absolutely uncivilized, unprofessional, and in sum entirely unacceptable lies about my personal and professional integrity. Mr President, as can be seen the criterion of identity does not guarantee uniformity of all of the members of the target group. Not unlike You Mr. President, yet with all the respect, quite a bit longer and with considerable more visible success I have built my academic and professional acumen within some of the most prestigious global institutions, and thus I know that I deserve respect, which I shall needless to say get, instead of uncultured and fabricated lies. I am indeed lead to inexcapable conclusion that it is indeed solely my ethnic background (of which I am most proud, Mr. President), that makes You incapable of grasping notorious facts related be it to my humble persona, neither the ones I have in barring full responsibility described in relation to long overdue necessity of placing the equal sign between ontological meaning of word justice and law for numerous subjects of Yours Mr. President of the Government of Croatia.

Mr. President, with my whole being I do pray that I am at fault at least to a minimal degree, and that there is still statesmanship capability within You, that would allow for the introduction of lex domicilii, which would be applied to all of the citizens of the Republic of Croatia, regardless of their ethnic, religious or any other demographic form of background. Mr. Sanader, neither Your deeds nor mine shall be judged by the international community; quite contrary they will be judged by the future generations which are yet to come, and that Mr. President places formidable responsibility both on You and on myself to do our outmost, and indeed inevitable. Lex malla, lex nulla and for that reason I stand firm in my belief that there is a way of reaching equitable, yet at the same time speedy solution... No Mr. President of the Government of the Republic of Croatia, I stand firm in my believe that the Constitution of the Republic of Croatia is the highest legal institution within the country whose Government You are heading, and that in the preceding period which was heavily charged by uncivilized emotions, on all sides to be understood, and which did not allow but monolithic of nationalistic stands has to be finally annihilated, annihilation that has to be remembered by future generations as a period of Constitutional enlightenment. Any alternative approach would put You personally Mr. President on a direct collision course not only with the Constitution of Republic of Croatia but with many more multilateral agreements most of which bare Your own signature.

Finally, Mr. President, as a professional that is approaching his duties without any emotions and who is ready and willing to utilize any and all of the assets that are on my disposal, I am giving You as a collateral my word that there exists no gesture, personality or situation that would influence in any way, shape or form the operations of the Organization that I am proudly heading. Mr. President of the Government of the Republic of Croatia, up to this very moment I have not seen any viable reason for meeting with You, with all respect, thus Your statement that I have requested one can not be further from the truth than it was in a moment when it was said. However, as I am absolutely sure that You are aware of the changed circumstances, and thus I shall allow myself the right to suggest urgent meeting in order to prevent any more damage that is inevitable in the case of the contrary.

Mr. President of the Government of the Republic of Croatia dr sc Ivo Sanader, I shall allow myself at this juncture to stress in a strongest manner that my words do not represent "fairytales" but the inevitability that is steaming from the notorious fact that tens, even hundreds of thousands of citizens of Croatia are clients of Organization "Trkulja & Associates" that I myself am so very proudly heading, and that means Mr. President that my sole responsibility is towards my clients and the protection of their Constitutional rights. For that reason I shall appeal to You one more time to, as a Leader of the Government of Croatia, accept the notorious facts as sine qua non for any movement of Your country in a desired direction of full partnership with the European Union.
